Should I Seek Legal Consultation After Being Involved In A Car Accident?

If you are involved in a motor vehicle accident, there are really only two outcomes. Either you caused the car accident, or someone else caused the car accident. There is a third possibility- extremely remote- where both individuals are equally at for causing an accident. But in the more common scenario, one driver or the other made the mistake.

I’ve never seen a situation where it doesn’t make sense to talk to a lawyer after being involved in a car accident.

Now, ultimately if you are sued or a legal claim or insurance claim is made against you, your insurance company will adjust and handle that claim for you and if indeed a lawsuit is filed, they will hire or refer a case to an attorney who will defend you. The downside is you would likely not be able to speak to that attorney, or indeed know who that attorney is, until after suit has been filed. If you feel you’ve caused the car accident it makes sense to call a lawyer and find out what your legal rights and legal options may be. Perhaps you are wrong about causation.

If the accident was not your fault -particularly if you sustained an injury- it’s vital that you speak to a personal injury attorney.

I’ve answered many a phone call from the scene of a motor vehicle accident, but I’m Attorney Eric T. Kirk not suggesting it is necessary that you call the personal injury lawyer at the scene. You can.  I’ve consulted with many individuals who call a lawyer before seeing a doctor or being evaluated medically. There’s nothing wrong with that ordering of events, and it’s a personal choice to seek legal advice before medical. My general marching orders are to get your body and health checked out first, then worry about less important things like legal claims.

An attorney can, of course, offer invaluable guidance as to your legal rights and obligations and those important first steps to take immediately after an accident, at the scene of an accident, and in the following days.
