Let’s analyze the facts of hypothetical but illustrative car accident with injury occurring in Baltimore’s Govan’s neighborhood. June 26, 2024, at 3:45 PM Intersection of York Road and Woodbourne Avenue. Vehicle one is 2020 Toyota Camry and the other vehicle is a 2018 Honda Civic Vehicle 1 was traveling north on York Road. Vehicle 2 was traveling west on Woodbourne Avenue. The collision occurred in the middle of the intersection when Vehicle 1 allegedly ran a red light and struck the passenger side of Vehicle 2. Vehicle 1 sustained front-end damage, deployed airbag, whereas vehicle 2 sustained significant side damage, deployed airbags. All drivers had injuries, were treated at the scene and taken to MedStar Good Samaritan Hospital for evaluation. Several witnesses reported seeing Vehicle 1 running the red light, but one witness, a pedestrian, claimed that Vehicle 2 had the green light and was proceeding through the intersection correctly. This is a classic red-light green-light case. When such a duty clearly exists, the general doctrine above, that a witness should have personal knowledge, need not stand in the way, for (as already noted) it has its conceded limitations; and where the officer is vested with a duty to ascertain for himself by proper investigation, this duty should be sufficient to override the general principle. It is true that due caution should be observed before reaching the conclusion the law has in fact in a given case intended to invest the officer with such an unusual duty.”

In my experience as a personal injury and accident attorney who routinely handles cases in the Govans neighborhood of Baltimore MD, I would say that judgs do not admit the crash report of officers who did not observe the car accident, without elaborate showing regarding that officers skills, training and experience, in “reconstructing” accidents.
