It’s a very important question and one that’s very difficult to answer. It also can’t be answered in a vacuum. It’s probably the key role of a personal injury attorney to give a client an intelligent assessment of the value of their case, and the value of their case is really what could we expect on this case if we went to trial? There’s a variety of considerations that go into this analysis. What is the amount of the economic damages, medical expenses, lost wages in the case? Where would the case be tried if it went to trial? How much is the applicable insurance coverage? A variety of other factors. When all of that information is known to an attorney, he or she should be able to give an intelligent range of value to the client. Now, the old adage that a claim is worth three times whatever the medical expenses are simply isn’t a valid tool for judging the value of a personal injury case.
Putting an appropriate value on a case is one of the most important things a personal injury attorney does. The most important thing is actually recovering that money for you.
