CASE STUDY: Car Accident Scenario in Guilford in Baltimore, MD

Accident Facts: Driver B was headed east a one way suburban road in Guilford. Driver B was headed south, on a on way street, that intersected with the road driver A was on, in a four way intersection. The names of the streets are not important for this hypothetical. B stopped at her sign, and pulled out, striking A, who claims that B made an “illegal left turn”, and was, therefore at fault.  

Cause Determination

The trial that Follows this Baltimore car accident may very well involve the application of a little-known provision of Baltimore traffic laws. It’s generally accepted knowledge that if you were facing a red light or a stop sign and there are no contrary signs you may make a right hand turn if traffic permits and it is safe to do so. It is less commonly understood that in Baltimore if you were facing a traffic light or a stop sign and making a turn from a one-way street onto a one way street, it is safe to do so, and there are no traffic signs prohibiting the movement -you can also make a left turn from a red light onto a one-way street. At trial, the plaintiff, driver A argues that the defendant made a left-hand turn against a red light and is therefore responsible for the accident. The trial judge pointed out on several occasions there were likely better arguments available to Plaintiff’s counsel.

Maryland Transportation Article, 21-202:

  (i)    Unless a sign prohibiting a turn is in place, vehicular traffic facing a steady red signal, after stopping as required by subsection (h) of this section, cautiously may enter the intersection and make:

        (1)    A right turn; or

        (2)    A left turn from a one-way street onto a one-way street.

    (j)    If a sign permitting any other turn is in place, vehicular traffic facing a steady red signal, after stopping as required by subsection (h) of this section, cautiously may enter the intersection and make the turn indicated by the sign.

If the plaintiff can prove that the street onto which they turned was one way, and the other requirements of the statutory provision we met, the ultimate decision to be made by the trial judge is if the movement could be made safely. Here the trial judge may very well determine that although the plaintiff had every right to make that left-hand turn onto a one-way street, they could not do so safely as evidence if by nothing else the ensuing collision.
