Why are There Car Crashes in Baltimore’s Brooklyn Neighborhood?

Case study: We are analyzing an interpretive hypothetical MVA accident occurred at the intersection of Patapsco Avenue and Hanover Street, a busy crossroads known for heavy traffic flow during rush hours. This accident happened on a weekday morning during rush hour, amidst heavy rain, reducing visibility and increasing road slickness. The collision involved three vehicles—a sedan, an SUV, and a pickup truck. The sedan was traveling westbound on Patapsco Avenue, the SUV, facing a sold green circle, was turning left onto Hanover Street from Patapsco Avenue, and the pickup truck was heading north on Hanover Street. The SUV attempted to make a left turn onto Hanover Street but misjudged the speed of the sedan approaching from the opposite direction. The sedan collided with the front passenger side of the SUV, causing it to spin and collide with the pickup truck traveling northbound on Hanover Street. Several occupants of the vehicles sustained injuries of varying degrees. The driver of the sedan suffered minor cuts and bruises, while the occupants of the SUV and pickup truck were transported to the hospital with more severe injuries, including whiplash, broken bones, and head trauma.

Legal analysis: The following statutes will likely be implicated in the ensuing lawsuit. As a car accident lawyer for Baltimore’s Brooklyn neighborhood, I can anticipate that one issue in the legal case will be the light. If red, liability on the part of the SUV driver is clear. It is equally clear, I would argue, in light of section 21-402 of Maryland’s Transportation Article, which provides:

“If the driver of a vehicle intends to turn to the left in an intersection or into an alley or a private road or driveway, the driver shall yield the right-of-way to any other vehicle that is approaching from the opposite direction and is in the intersection or so near to it as to be an immediate danger.

The courtroom argument, here, would be that since an accident did, in fact, ensue, there was an immediate danger of a collision, and the SUV driver failed to heed that danger, and accordingly caused the accident.
