Historically, one could obtain benefits, or could decline the availability benefits at least as to themselves-but not for their passengers- by telling their insurance company they did not want the coverage, signing something to that effect, and not paying premiums for the coverage. The Assembly has recently enacted a change in this process. Marylanders now have the option of carrying less insurance. An insured may now reject personal injury protection altogether, so long as

The policy at issue is a minimum coverage [i.e. 30k policy], and either:

  • If the policy is offered by the Maryland Automobile Insurance Fund [the MAIF] the applicant has not been insured continuously by the MAIF for at least 1 year.
  • If the policy is offered by insurer other than the MAIF and  prior to the application, the applicant was insured by an insurer other than the Maryland Automobile Insurance Fund; and that insurer canceled the policy.
